These Terms of Service form a binding agreement between you and Narrabytes LLC for the use of Marketist.ai.

1. Description and Eligibility

Marketist.ai is a SaaS marketing automation platform for businesses that want to plan, launch, and optimize digital advertising campaigns. You must be at least 18 years old and have authority to bind the entity you represent.

2. Account and Authorization

Account security

You are responsible for accurate registration details and for keeping credentials confidential.

Ad account management

By connecting an ad platform account, you authorize Marketist to manage campaigns on your behalf within the scope of the Service.

3. Fees, Wallets, and Billing

  • Subscription fees are billed in advance and are non-refundable except where required by law.
  • Media spend is funded in advance through a wallet system and may be paused if balances are insufficient.
  • A 5% service fee on gross media spend applies to funds processed through the Service.
  • Taxes, platform policies, and ad delivery outcomes remain your responsibility.

4. Content, IP, and Acceptable Use

You agree not to use the Service unlawfully, to violate ad platform policies, to reverse engineer the Service, or to misuse the platform in ways that could harm Marketist or others.

Your content

You keep ownership of your content and grant Marketist a license to use it only to provide the Service.

Your warranties

You warrant that uploaded materials are properly licensed and do not infringe or violate third-party rights.

5. Disclaimers, Liability, and Indemnity

The Service is provided as-is, without guarantees of performance, uptime, or advertising results. To the maximum extent permitted by law, Marketist's liability is limited, and you agree to indemnify Narrabytes LLC for claims arising from your use of the Service, your content, your campaigns, or your violation of these Terms.

6. Privacy, Termination, and Governing Law

Privacy

Your use of the Service is also governed by our Privacy Policy.

Termination

We may suspend or terminate access for non-payment, fraud, policy violations, or misuse.

Governing law

These Terms are governed by the laws of the State of Illinois.
